Delta-8 vs. CBD: What the Label Distinction Is
Delta-8 THC and CBD are different compounds, and a delta-8 product is not a CBD product. Delta-8 is a form of THC — a positional isomer of the more familiar delta-9 — and in consumer products it is usually made by chemically converting CBD rather than extracted from the plant in quantity.
They end up next to each other on shelves because both are commonly sold under hemp frameworks. But they are distinct on the label, distinct on a lab report, and treated very differently across jurisdictions. Confusing the two is the single most consequential mix-up in this category.
What the names actually denote
- CBD (cannabidiol) — a cannabinoid the plant produces in quantity. Not a form of THC.
- Delta-9 THC — the compound legal thresholds are usually written against, and the one whose metabolite standard drug tests look for.
- Delta-8 THC — the same molecular formula as delta-9 with a double bond in a different position. Present in the plant only in very small amounts, which is why commercial material is made by conversion.
The “delta” number refers to where that double bond sits. It is a small structural difference by the standards of chemistry and a large one by the standards of law and testing.
Why the conversion step matters on the label
Because delta-8 occurs naturally in tiny amounts, commercial delta-8 is typically produced by treating CBD with an acid catalyst to rearrange the molecule. This is routine chemistry, and it is also the reason delta-8 products raise a testing question that CBD products do not.
An isomerisation reaction does not produce one product cleanly. Alongside the intended delta-8, a reaction can leave unreacted starting material, other isomers, and reaction byproducts. Whether those are present and at what levels is a question for a lab report on the finished batch — and it is a question the standard cannabinoid panel does not fully answer, because a panel only reports the compounds it is set up to look for.
So on a delta-8 product, the useful questions are different from the ones you would ask about a CBD tincture:
- Does the report list delta-8 specifically, and how much?
- Does it list delta-9 THC as well, and at what figure?
- Does it show residual CBD from incomplete conversion?
- Are other isomers reported, or is the panel silent on them?
- Is there a residual-solvent panel covering the reaction chemistry, not just the original extraction? The vocabulary is in extraction words on a label.
A panel that reports only delta-8 and nothing else has told you almost nothing about what else is in the bottle.
How the labels differ
Delta-8 packaging tends to use its own vocabulary, and learning it prevents accidental purchases.
- “Delta-8”, “D8”, “Δ8” — the product’s active compound is delta-8 THC.
- “Hemp-derived THC” — a phrase that can cover delta-8, delta-10, and other variants. Note that it says THC, not CBD.
- “HHC”, “THC-O”, “THCP”, “delta-10” — further compounds in the same commercial family, each with its own chemistry and its own regulatory ambiguity.
- “Psychoactive” or “intoxicating” on packaging — a strong signal you are not looking at a CBD product.
- “Full spectrum” on a delta-8 product — the category words from the spectrum post are sometimes borrowed here, where they mean less, because the active compound was made rather than extracted.
Conversely, a CBD product’s label should name cannabidiol or hemp extract as the active ingredient, and its THC content should read as a trace figure or a non-detect rather than as a headline.
The legal position is different, and it is unsettled
Delta-8’s regulatory status is genuinely contested in a way CBD’s is not. The reason is structural: hemp definitions were written around a threshold applied to what a plant produces, and a compound synthesised from a plant-derived precursor sits awkwardly against that language.
The consequence is a patchwork. Some jurisdictions treat converted cannabinoids as controlled. Some restrict them by potency, format, or age. Some have addressed them specifically in legislation; others have not. It has been litigated as well as legislated, and positions have changed more than once.

The testing point, stated plainly
Delta-8 is a form of THC. Standard workplace immunoassay screens for cannabinoids are not designed to distinguish between THC isomers, and confirmation testing looks for a specific metabolite of delta-9.
We are not going to tell you what will or will not happen on a given test, because that depends on the product, the programme, the cutoffs, and factors specific to you. What we will say is that treating a delta-8 product as equivalent to a THC-free CBD product for testing purposes is not supportable. The two are different compounds and the assumption has no basis in the label.

The commonest way people end up with a delta-8 product by accident is a shelf where both sit under a “hemp” heading in similar packaging.
- Read the active ingredient, not the shop’s category sign.
- Look for the word THC anywhere on the front, including in phrases like “hemp-derived THC”.
- Check for intoxication language, which CBD packaging should not carry.

- If the paperwork does not distinguish the isomers, treat the contents as unknown.
The one-line version
CBD is a cannabinoid that is not THC. Delta-8 is a THC isomer usually manufactured from CBD. The words look adjacent on a shelf and are not adjacent in chemistry, in law, or in what a test is looking for.
